STATE LEGISLATOR NEWS
PAUL LAMBERT
May 11, 2012, Lincoln— When the legislature adjourns for the year, interim studies are conducted by legislative committees. The purpose of each study is defined in a resolution that is introduced by a senator or a committee before the session ends. The resolution authorizes a committee to conduct research on a policy issue between legislative sessions. Each committee's chairperson submits a study plan to identify prioritized topics. The committee’s legal counsel coordinates the study plan. If the study requires a significant amount of time and research, legislative aides, whose senators serve on the committee, may be invited to lend assistance.
An interim study may resolve the issue that prompted its introduction, or it may produce a bill for the next legislative session. If new legislation is expected, the committee may schedule one or more hearings to seek public input. Hearings are usually held in the fall. Some committees schedule hearings at the Capitol in Lincoln. Others hold hearings in communities throughout the state to give more citizens a chance to learn about the issue under review.
This year 120 interim study resolutions were introduced. Like legislative bills each resolution is assigned to a legislative committee based on the subject to be studied. If a resolution's focus is broad, it may be assigned to more than one committee for joint consideration. Thirty-one resolutions were directed to the four committees on which I serve. The Health and Human Services and Urban Affairs Committees are responsible for 26 of the studies.
LR 552 is the first priority on the Urban Affairs' agenda. This study by Committee Chairman Amanda McGill of Lincoln will examine economic development in rural areas of the state, with a focus on cities of the first and second class, and villages. Through LR 501 the committee will examine the relationships between municipal and state governments in Nebraska. The Urban Affairs and Revenue Committees will collaborate on two studies. One of them - LR 553 calls for an examination of strategies to promote the restoration and revitalization of historic business districts throughout the state. In District 2 Nebraska City and Plattsmouth continue to benefit from the Nebraska Main Street Program's preservation-based strategy for rebuilding and strengthening businesses to support sustainable communities. I will be pleased to participate in a search for new ways to protect the historic center of other communities in our district and throughout the state.
The Health and Human Services (HHS) Committee will continue its evaluation of the state's child welfare system during the interim. LR 525 calls for the HHS and Judiciary Committees to examine how Nebraska's system for screening, assessing and investigating reports of child abuse and neglect contribute to our state's unusually high rate of out-of-home foster care. The HHS Committee will also gather data and develop recommendations on the unmet needs of and gaps in services available to youth who transition or “age-out” of Nebraska's foster care system.
In 2001 LB 692 was passed to provide a policy framework for the use of the Nebraska Health Care Cash Fund (NHCCF) and establish Nebraska's share of tobacco settlement funds as one of two sources of revenue for the NHCCF. The intent of LB 692 was to use the funds for health-related purposes. Nebraska has an excellent record of using the funds appropriately, but the state's investment council cautioned last fall that if the current level of commitments is not reduced, spending will result in a declining NHCCF balance. LR 508 calls for the HHS Committee to review, assess and provide recommendations about the implementation and sustainability of the NHCCF. LR 549 asks the HHS and Appropriations Committees to determine the range of investment returns on the NHCCF over the next ten years and the actual needs of the current funding recipients over the same time period. The NHCCF provides valuable support for health-related needs in our state. It must receive vigilant oversight to ensure its continued existence well into the future.
I am always interested in hearing your comments by mail, phone or email.
